Terms of Service
Last updated: 2026-04-29 · This is the buyer-side agreement. Sellers operate under a separate Consignor Agreement signed at onboarding.
1. Who can use the platform
This platform is open to natural persons who are residents of the United States, are legally permitted to own firearms under federal law, and are at least 21 years old (handguns) or 18 (long guns). By creating an account you represent that all of those statements are true. Anyone prohibited from possessing firearms under 18 U.S.C. §922(g) — including persons with disqualifying criminal histories, persons subject to qualifying restraining orders, or persons adjudicated mentally defective — may not register, bid, or buy.
2. What we enforce, what you must verify
We apply state-of-FFL filtering to every listing — items that are categorically prohibited in the state of your preferred FFL dealer are hidden from browse and rejected at bid placement. We do not apply rules that depend on personal-history data we deliberately do not collect: California's 30-day prior-purchase rule, possession of a current FOID / FPIC / HQL / LTC, or your individual eligibility under federal, state, or local law. By bidding you represent that you have verified your own eligibility for the specific item and that you will be able to take possession at your selected FFL pickup point.
See How It Works for the full state-by-state summary.
3. Bidding and payment
Bids are binding. The platform applies row-level locking to ensure exactly one winning bid per auction. Anti-snipe extensions apply when the seller enables them. You authorize the platform to charge your card / bank for the full amount upon settlement; a manual-capture authorization is taken at the moment of winning, and captured at the time you complete checkout.
4. Shipping and FFL pickup
Firearms ship only to the licensed FFL dealer you have selected — never to a residence. Pickup at the FFL is at no additional cost; the FFL is reimbursed by the platform. State-mandated waiting periods, ID verification, permit verification, and background checks are performed at the FFL, on the same terms as an in-store sale.
5. Refusal at pickup
If you cannot complete the transfer at your selected FFL — failed background check, missing permit, locality-specific bar, or failure to appear within the dealer's holding window — the firearm is returned to the seller. The first such occurrence on your account results in a full refund; the platform absorbs round-trip shipping. On the second occurrence, the round-trip shipping cost (both legs) is deducted from your refund and the remainder is returned to your original payment method.
6. Disputes
Disputes between buyer and seller (item-not-as-described, item-not- received, damage in transit, wrong item, compliance issue) are filed on the platform within 30 days of pickup. The platform arbitrates and selects one of: full refund, partial refund, release to seller, or relist. Resolution outcomes are recorded on the order; refunds are applied to the original payment method.
7. Prohibited conduct
You may not use the platform to conceal prohibited items, attempt to transfer to a state where the item is banned, evade waiting periods, engage in straw purchases, or shill-bid. We monitor for shill-bidding, unusual velocity, and device-fingerprint anomalies; accounts engaged in prohibited conduct are suspended immediately and reported to law enforcement where required.
8. Account suspension and termination
The platform may suspend or terminate your account at any time for violations of these terms, suspected fraud, or compliance with law enforcement. Suspension blocks new bids; existing winning bids continue through pickup unless the violation requires unwinding. Termination is permanent and may be appealed in writing.
9. Disclaimers
The platform's compliance filtering is provided "as is." We rely on seller-declared compliance attributes and on per-state rule data we maintain in good faith. Statutes change. The ATF and your state Attorney General are the authoritative sources. If anything on this platform conflicts with current law, the law wins. Nothing on this platform constitutes legal advice.
10. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Disputes between you and the platform are subject to binding arbitration in Wilmington, Delaware, except that either party may seek injunctive relief in court for intellectual-property or compliance violations.
11. Changes to these terms
We may update these terms; the "last updated" stamp at the top reflects the most recent revision. Material changes are emailed to active accounts at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance.
